How much can I expect to receive?

The value of your case cannot be determined until your unique case is evaluated. Our law firm will analyze your case individually and give you a more accurate assessment of what you can expect to receive. We will value your claim as it progresses. We won’t be able to give you a full value until you are recovered from your injuries and have finished your treatment. We have successfully collected many millions of dollars in settlements and benefits for our clients and we always strive to recover the full value for each case.

How much are the legal fees?

We represent most cases on a contingent basis. Attorney fees are a percentage of the recovery and received only if your case is won. Fees are computed before deduction for costs. Rules require that clients are ultimately responsible for the expenses regardless of outcome. Legal and court fees are different for every case and will be explained upfront.

  • Social Security cases: 25 percent of back pay up to $4,000 maximum recovery
  • Personal injury cases:
    • 33 percent of gross amount received if settlement occurs prior to commencing lawsuit
    • 35 percent of gross amount received if settlement occurs after lawsuit is filed
    • 45 percent of gross amount received if a settlement occurs after an appeal is filed
  • Workers’ compensation in South Dakota:
    • 25 percent of gross amount if the case is settled before hearing
    • 30 percent of gross amount if a hearing is required
    • 35 percent of gross amount if either party files an appeal
  • Workers’ compensation in Iowa:
    • 33 percent of gross amount received if the case is settled before hearing
    • 40 percent of gross amount received after hearing and filing in circuit court
    • 45 percent of gross amount after appeal to the Iowa Supreme Court

What damages am I entitled to collect?

For personal injury cases, the following are damages you may be able to collect:

  • Past and future medical bills
  • Past and future pain and suffering
  • Past and future lost wages
  • Permanent disfigurement or scars
  • Permanent injury or disability
  • Mental trauma/psychological injuries
  • Loss of earning capacity
